NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN — READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE RELEASED PARTIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

Event Details

Event: Wakeboard Camp at Lake Caroline  |  Sponsor: WWA - Sanctioned Event (thewwa.com)  |  Location: Lake Caroline, Mississippi  |  Date: August 15, 2026 · 9am-4pm. Participants limited to children ages 7-15 who are residents or family members of residents. Limited to 20 participants, first come first served.

1. Definitions

The child taking part in the camp is referred to as the "Participant." "Undersigned" means the Participant's parent or legal guardian signing below on the Participant's behalf. "Released Parties" means the Lake Caroline HOA (not a sponsor of this event) and its board members, officers, and agents; the volunteer instructors, boat operators, spotters, and event staff; property owners hosting or involved in the event; and WWA and other sponsors or affiliated organizations, together with their respective successors, insurers, employees, and representatives. The "Activity" means waterskiing, wakeboarding, wakesurfing, kneeboarding, tubing, or any other towed watersport, boating, swimming, and use of docks and related watersports facilities for any purpose in connection with the camp.

2. Acknowledgment of Risks

I, the undersigned parent or legal guardian, understand and acknowledge that water skiing, wake sports, boating, swimming, dock use, and related recreational activities involve inherent risks and dangers that may result in serious bodily injury, illness, permanent disability, death, emotional distress, or property damage. Such risks include but are not limited to: actual or alleged transmission of a communicable disease such as COVID-19; falls while skiing or entering/exiting the water; teaching techniques, lessons, or coaching; collisions with boats, docks, skiers, or other obstacles; boat accidents, boat speed, or operator error; equipment failure or defects; tow rope injuries and entanglement; drowning; capsizing; water flow, tides, currents, and wakes; slips and falls on docks or shorelines; exposure to weather, heat, sun, insects, wildlife, or waterborne hazards; mental distress arising from any of the foregoing; and the negligence of employees, volunteers, or other individuals. I VOLUNTARILY PERMIT THE PARTICIPANT TO ENGAGE IN THESE ACTIVITIES WITH FULL KNOWLEDGE OF THESE RISKS, AND I ACKNOWLEDGE AND UNDERSTAND THAT THE RISKS LISTED ABOVE ARE NOT A COMPLETE LIST AND THAT PARTICIPATING IN THE ACTIVITY MAY INVOLVE OTHER RISKS NOT DESCRIBED HERE.

3. Boating Safety Acknowledgment

I understand that participation includes time in and around motorized watercraft. I agree that the Participant will: wear a properly fitted USCG-approved life jacket when required; remain seated while the boat is underway unless instructed otherwise; keep hands, feet, ropes, and equipment clear of the motor and propeller; follow all instructions from boat operators, spotters, and instructors; and immediately report injuries, equipment concerns, or unsafe conditions. Failure to follow safety instructions may result in removal from activities.

4. Assumption of Risk

I knowingly and voluntarily assume all risks and dangers associated with participation in the Wakeboard Camp, whether known or unknown, foreseeable or unforeseeable, inherent or otherwise, including risks arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law. I recognize that property loss, injury, and death are all possible while participating in the Activity, and, recognizing these risks and dangers, I voluntarily choose to allow the Participant to participate and expressly assume all such risks.

5. Release and Waiver of Liability

I HEREBY IRREVOCABLY AND UNCONDITIONALLY RELEASE, FOREVER DISCHARGE, AND AGREE NOT TO SUE OR BRING ANY OTHER LEGAL ACTION AGAINST the HOA (not a sponsor of this event); HOA board members, officers, and agents; volunteer instructors, boat operators, spotters, and event staff; property owners; and sponsors and affiliated organizations (the "Released Parties") — with respect to any and all claims, demands, damages, losses, or liabilities of any nature, whether currently known or unknown, arising out of the Participant's involvement in the Wakeboard Camp, including but not limited to claims of ordinary negligence, breach of warranty, and/or breach of contract. This release does not apply to gross negligence or willful misconduct.

6. Medical Authorization

I certify that the Participant is physically capable of participating. If I cannot be contacted immediately in an emergency, I authorize the HOA, its volunteers, and emergency personnel to call for medical care, and to transport the Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. I agree to be solely responsible for any and all costs associated with such medical care and related transportation.

7. Minor Acknowledgment

Because the Participant is a minor, I acknowledge that I am signing this Agreement both on my own behalf and on behalf of the minor Participant, and that the Participant shall be bound by all the terms of this Agreement. By signing, I understand that I am also waiving rights on behalf of the minor Participant that the minor may otherwise have, and I agree that, but for signing this Agreement, the Participant would not be permitted to participate in the camp. I represent, under penalty of fraud, that I am a legal parent or guardian of the Participant and have the authority to sign this Agreement on the Participant's behalf.

8. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liability, cost, expense, or damage of any kind, and from any suits, claims, or demands, including legal fees and expenses, arising out of or related to the Participant's participation in the Wakeboard Camp. This indemnification obligation shall survive the conclusion of the Participant's participation in the camp.

9. Miscellaneous

I further agree and understand that: (a) the Participant will not engage in any activity prohibited by applicable laws, statutes, regulations, or ordinances; (b) this Agreement is governed by the laws of the State of Mississippi, and the exclusive venue and jurisdiction for any claim arising out of this Agreement shall be the state courts located in Madison County, Mississippi, to which I expressly consent; (c) this Agreement is the entire agreement between the parties regarding its subject matter and supersedes any prior oral or written communications or representations; (d) this Agreement is a binding contract to the fullest extent permitted by law, and if any part of it is found unenforceable, the remaining terms shall remain a valid and enforceable agreement between the parties; and (e) this Agreement binds my and the Participant's heirs, next of kin, executors, and personal representatives.

Disclaimer

This event is in no way connected to LCOA, its affiliates, residents, employees, directors, committee members, HOAs, or any other associations regarding the Community of Lake Caroline. This is a free, private event promoted by residents for children ages 7-15.

I HAVE CAREFULLY READ THE FOREGOING ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM RELEASING LEGAL RIGHTS THAT OTHERWISE MAY EXIST FOR MYSELF AND ON BEHALF OF THE PARTICIPANT.
